When are police certificates required for immigration to Canada?

A police certificate confirming a criminal record or its absence is a document Canada’s immigration department (IRCC) uses to check an applicant’s criminal history.

In different countries, such a document may be called differently. Official IRCC generic term:

certificate confirming a criminal record or its absence (police certificate).

Main rule:

You cannot use one universal list of countries for all immigration programs.

For example, Express Entry has a specific rule based on age, period of residence, and last 10 years. Requirements may vary for other programs.

What a police certificate is, in simple terms

This is an official criminal history document.

The certificate shows that the person has no criminal record or contains information about a criminal history, if any.

IRCC uses it to check circumstances that may affect admission to Canada.

It is better to look for the required document according to the official IRCC instructions for your country: the name depends on local rules.

What can the document be called:

  • police clearance certificate
  • good conduct certificate
  • extract from the judicial register (judicial record extract)

Other names are possible according to local regulations.

PROGRAM REQUIREMENTS

Different programs have different rules

Do not carry over Express Entry requirements to any other submission.

IRCC explicitly states that the timing and requirements for police certificates depend on the program.

This page discusses the Express Entry logic in detail, because it is there that the rules are well standardized.

If you are applying for another program:

  • open the program instructions
  • check the list of documents
  • use country specific IRCC instructions

Don't follow the rule:

“6 consecutive months always works the same for any Canadian visa or program.”

AGE AND FAMILY COMPOSITION

Express Entry: who the system usually invites to provide certificates

You and family members are over 18 years old.

In Express Entry, the system usually requests a police certificate:

  • from the main applicant
  • family members who are 18 years of age or older
  • for each country where the person concerned has been in the last 10 years 6 consecutive months or longer

In this case, as a standard, you do not need to submit the following certificate:

  • for a period up to 18 years
  • for the time spent in Canada

After filing, the officer can still request additional certification for another period of life after age 18.

UNINTERRUPTED STAY

What does "6 months in a row" mean?

Express Entry is based on continuous period of stay.

How to compare trips:

  • 7 consecutive months in one country usually fall under the rule
  • Individual trips of 3–4 months do not automatically add up to one six-month period

When additional request is possible:

In the IRCC example, the person traveled to Spain for separate four-month periods over several years. The Express Entry system did not automatically require a certificate because no period reached 6 consecutive months.

The officer can still request such a certificate later. The absence of a field in the system does not exclude an additional request.

DEPTH OF HISTORY

What does "last 10 years" mean?

This is a separate Express Entry restriction.

In Express Entry, the system takes into account countries where you have been for 6 consecutive months or longer within the last 10 years.

For example, if a person is 45 years old and lived for 7 months in another country at the age of 25, the Express Entry system will usually not ask for this certificate initially because the period was more than 10 years ago.

But after filing, the officer can request a certificate for any period after 18 years.

Therefore, old history cannot be considered completely unimportant just because of the ten-year rule.

ISSUED DATE

Country where you live now

The rule here is 6 months before the filing date.

For the country of your current residence, the certificate must be issued:

no more than 6 months before the date of application.

The certificate must not be expired as of the date of submission.

IRCC may ask for an updated certificate later during the review process.

Important:

current country of residence is not necessarily the country of citizenship.

If you currently live in another country, the current country rule applies specifically to your place of actual residence.

AFTER CHECKOUT

Countries where you have lived before

The date after the last long stay is important here.

For another country, the certificate must be issued:

after the last period you were there for 6 consecutive months or longer.

This is different from the current country.

For example:

  • you lived in the country for 2 years
  • left
  • after departure we received a certificate

Such a document may continue to be eligible even later if it complies with the IRCC rule.

LOCAL VALIDITY

What if the certificate from the previous country has already “expired”

In Express Entry, the date on the certificate may be more important than its local date.

Some countries print their own expiration date.

IRCC states that a certificate from a country where you no longer live may be accepted even after the deadline stated on it if:

  • it was issued after the last stay there for 6 consecutive months or longer
  • this is not your current country of residence

IRCC may still request an updated document during the review process.

Therefore, one rule cannot be applied:

“The certificate says expired, which means it is definitely unsuitable.”

INITIAL SET

Do I need to get a certificate from Canada?

For standard Express Entry filing, a Canadian certificate is not required in advance.

IRCC's current Express Entry guidelines specifically state that proof of time spent in Canada does not need to be submitted with the initial application package.

But the officer may request additional verification later.

Do not automatically request a Canadian police certificate simply because you have lived in Canada.

First follow your document checklist and IRCC requests.

DATE PLANNING

When is the best time to start receiving certificates?

Some countries take a long time to issue them.

IRCC advises Express Entry candidates to think about certifications after the profile is in the pool.

Once an Invitation to Apply (ITA) is received, you have 60 days to submit your Express Entry application.

If a country takes a long time to issue a certificate, waiting until the last few days can create a problem.

Therefore, it is useful to determine in advance:

  • from which countries certificates will potentially be needed?
  • how long does the procedure take
  • Is personal presence required?
  • are fingerprints needed?
  • is a formal request letter required from IRCC?
SPECIAL ISSUE PROCEDURE

Some countries require a formal letter of request from IRCC

Such a certificate cannot simply be ordered in advance.

Some countries issue a certificate only after a formal letter of request from IRCC.

In this case, the current Express Entry instructions provide for a special procedure.

In the certificate field for this country, a document is loaded explaining that an official IRCC request is required for its issuance.

If the application is otherwise complete, IRCC will send further instructions.

Therefore:

do not attempt to write a letter on behalf of IRCC yourself.

Use the formal process.

How to find out where and how to get a certificate

Use the IRCC country guide.

IRCC has a separate guide to countries and territories.

The following may differ for each country:

  • authority that issues the certificate
  • document title
  • order of submission
  • fingerprints
  • photos
  • address history
  • cost
  • need for a formal letter of request
  • method of receiving from abroad

This country-specific IRCC page should be your primary source.

Do not use instructions for one country as a guide for another.

TWO PROCEDURES

Fingerprints for reference and IRCC biometrics are two different things

Even if fingerprints are taken in both cases.

Some countries require fingerprints to issue a certificate.

The Canadian immigration system may also require biometrics - fingerprints and a photograph.

These are different procedures.

The fingerprints you submitted to receive your certificate do not automatically mean that biometrics for IRCC has already been completed.

Biometrics submitted to IRCC also do not replace the fingerprints required by the certificate issuing authority.

SCAN OF ORIGINAL

What file to upload to Express Entry

IRCC requires a color scan of the original certificate.

For Express Entry, IRCC specifies:

  • a color scan of the original certificate is uploaded
  • a certified copy does not replace the original certificate for this requirement
  • an unauthorized copy is also not accepted

Therefore, before downloading, check:

  • the document is completely visible
  • color saved
  • seals, signatures and numbers are not cut off
  • all pages included

Do not improve or edit the content of the document.

TRANSLATION OF DOCUMENT

If the certificate is not in English or French

Translation needed.

According to IRCC general instructions, if the certificate is not in English or French, you must provide:

  • original certificate
  • translation into English or French from a certified translator

For a specific immigration program, also check its document translation rules.

Don't just upload a translation without the original reference.

DELAY OF ISSUANCE

What to do if the certificate does not arrive in time

Express Entry may provide an explanation for the delay, but does not guarantee acceptance.

If the ITA certificate is not ready by the 60-day filing deadline, current Express Entry instructions allow you to attach:

  • explanatory letter
  • evidence that you made real attempts to obtain a certificate in a timely manner

For example:

  • confirmation of request
  • payment receipt
  • delivery notification
  • tracking number
  • explanation from the authority that issues the certificate

The letter and evidence are loaded into the country-specific reference field.

The officer decides if your attempts are enough.

If not, the application may be rejected as incomplete.

ACTION CONFIRMATION

What does “sufficient attempts” mean in practice?

IRCC does not provide a universal formula.

You can't say:

“one receipt is always enough.”

The situation looks stronger where you can see:

  • when did it become possible to order a certificate?
  • when did you actually order it?
  • that the request has been sent to the correct authority
  • that the delay is not up to you
  • that you were tracking the process

The situation looks weaker:

  • the candidate knew about the certificate
  • haven't done anything for a long time
  • submitted the request just before the deadline
  • did not attach confirmation

But the final assessment is still made by the officer.

OBJECTIVE OBSTACLES

What to do if it is impossible to get a certificate at all

You need to show both the reason and the attempts.

IRCC states:

If a certificate from the country cannot be obtained, the applicant must:

  1. show proof of requesting a certificate from the correct authority
  2. write a letter with all attempts to obtain the document

You can attach, for example:

  • receipt
  • tracking number
  • official answer
  • government agency page with explanation
  • description of the current situation in the country that prevents the receipt of the document

Even a complete package of explanations does not guarantee that IRCC will accept an application without a certificate.

WHICH ORGAN TO CHOOSE

If the country no longer exists or has changed its name

Certification requested from current national authorities.

IRCC specifically states that if you lived in a country that later changed name or status, the certificate must come from the current national authorities of that country.

If the country is not in the IRCC directory, you can contact:

  • to the national police
  • to the embassy
  • to the consulate of that country in Canada
BIOGRAPHY REVIEW

Certificate and travel history must be consistent

The information in the certificate must be consistent with the rest of the application.

Before submitting, compare the list of countries with:

  • address history
  • travel history
  • general occupational history
  • passports
  • information from previous immigration applications

For example, a person lived in the country for 8 months, but in the application this is only visible as several inconsistent entries.

Or vice versa: the package includes a certificate from a country where the person, judging by the questionnaire, has never been.

It is better to collect a separate table of countries and periods in advance.

REPEATE VISITS

Several short trips

Do not fold them automatically.

Express Entry looks at residency:

6 consecutive months or longer.

If a person traveled to one country several times for 2-4 months, the Express Entry system may not automatically require a certificate.

But:

  • the officer may request it later
  • a specific program may have a different instruction
  • a long history of frequent travel still needs to be reported correctly

So don't use the 6 month rule as a way to "ignore" a country in your travel history.

ADMISSION ASSESSMENT

What if a criminal history exists?

The certificate is not a legal opinion on admission.

Depending on the country, the certificate may contain:

  • criminal record
  • information about the charge
  • other criminal history information

The very fact of recording does not allow an automatic conclusion to be drawn from one page.

Canada's criminal inadmissibility rules depend on the specific offense, its Canadian equivalent, penalty, timing, and other circumstances.

If the certificate contains a record, it is better to examine the situation separately before filing.

Do not hide the document or try to edit its content.

Common mistakes

Apply Express Entry rule to all programs

Other programs may have their own instructions.

Stack multiple short trips into one six-month period

In Express Entry, 6 consecutive months are important.

Ordering a certificate from the current country is too early

As of the filing date, it must be issued no more than 6 months in advance.

Throw away the old certificate from the previous country only because of the validity period

For the previous country, it may remain acceptable under the IRCC rule.

Automatically requesting a Canadian police certificate

It is not required for standard Express Entry initial filing.

Send a certified copy instead of a color scan of the original

Express Entry requires a color scan of the original certificate.

Practical examples

Situation 1. Current country of residence

The candidate has been living in the country for the last 2 years.

For Express Entry, the certificate must be issued no more than 6 months before the filing date.

Situation 2. Country of previous residence

The candidate lived in the country for 3 years and left in 2023.

A certificate issued after the last period of residence of 6 consecutive months or longer can be used even later if that country is no longer the current country.

Situation 3. Several short trips

The candidate was in the country for 4 months, then left, then returned for another 4 months.

It's not 8 months in a row.

The Express Entry system may not automatically request the certificate, but the officer may request it later.

Situation 4. The certificate is delayed

The candidate requested the document immediately after the ITA, but the government agency did not have time to issue it.

An explanatory letter and confirmation of a timely request may be attached to the application.

This does not guarantee that IRCC will accept the application as complete.
